By signing up with Seventh Trumpet Media Inc. the customer herein known as “The Producer” agrees to the following terms and conditions:

1. Seventh Trumpet Media Inc. is the only owner of the artwork(s), work(s), or material(s) described offered on this website.
2. Seventh Trumpet Media Inc. irrevocably grants to the Producer (and to the Producer’s licensees, successors, and assigns) the permission to have itself or its contractors, agents or employees record and photograph the Material and the non-exclusive right to use and show the Material, as recorded or photographed by or for the Producer.
3. The Producer’s non-exclusive right to use and show its recordings and photographs of the Materials include Producer’s non-exclusive right to use in the documented audio-visual production and to incorporate the recordings and photographs or any versions or excerpts of this production may be included (such as, but not limited to, different language or versions of the production, “making of” documentaries, including the right of public exhibition, reproduction, distribution, publication, display, sales, rental, lending, and all other uses of such productions incorporating the Material in synchronization with the Series as well as all advertising, publicity, and promotion of such productions and works, throughout the universe, forever, and in all languages, media, formats and markets now known or hereafter devised).
4. Seventh Trumpet Media Inc. represents and warrants to Producer that Grantor is the author and only owner or the only owner or the only person with control over the Material, that Seventh Trumpet Media Inc.’s permission in the release is all Producer needs for the rights and permissions Seventh Trumpet Media Inc. has granted to Producer, and that the Material does not defame anyone and does not infringe upon anyone’s rights, including but not limited to copyright, privacy rights, or publicity rights. Grantor will indemnify and hold Producer and Producer’s successors, licensees and assigns harmless from and against any and all claims, damages, liabilities and/or expenses (including but not limited to reasonable legal fees), resulting from a breach of Grantor’s warranties and representations hereunder.
5. In connection with the authorized use of the Material under this release, Seventh Trumpet Media Inc. does not waive and relinquish author’s moral rights to the Material, other than the attribution in the production of the Materials being the work of one of the characters or the re-use of recording or photographs of the Material in related productions, which Producer has outlined for Grantor.
6. The Producer may also, as it chooses, edit, adapt, or combine these photographs and recordings of the Material with any other material for the purpose of the permitted uses under this release. Notwithstanding anything contained herein, Producer has no obligation to use the Material or any part of the Material.
7. Seventh Trumpet Media Inc.’s sole remedy in the event of a dispute under this release, or in the event of any breach by Producer of this release, shall be the recovery of money damages at law, if any, and the rights herein granted by Seventh Trumpet Media Inc. to Producer shall not terminate by reason of such dispute or breach, nor will Seventh Trumpet Media Inc. have any right to seek, obtain, or enforce any injunctive or other equitable relief against the Producer or the Production or any other work derived in whole or in part from the Production, all of which rights are expressly and irrevocably waived by Seventh Trumpet Media Inc. in favour or Producer.
8. All photographs and recordings made of the Material by or for the Producer (including all their masters, negatives, and reproductions) are sole property of the Producer. The Material remains the sole property of the Grantor.
9. This release shall be binding on the Grantor and the Grantor’s successors and assigns or heirs and executors (as the case may be) and is given under the laws of Ontario.
10. This release is the entire agreement of the Seventh Trumpet Media Inc. concerning the Material. No promise or understanding of any kind has been given by Producer or is relied upon by Seventh Trumpet Media Inc. other than as written here. This release may not be changed unless by an instrument executed by both the Seventh Trumpet Media Inc. and Producer.
